Lindsay Lohan a no-show in court; assault hearing postponed

Lindsay Lohan did not show up for a scheduled court appearance in New York on Monday, and her lawyer says the charges against her stemming from a night club altercation may be dropped, ABC News reports.

Lohan was not required to be in court Monday to answer to the charges, and her attorney, Mark Jay Heller, says she won't appear unless a formal criminal complaint is filed, he said outside of a New York courthouse Monday after signing paperwork. The Monday hearing was postponed because the investigation is continuing, according to the Manhattan District Attorney's Office.

On Nov. 29, Lohan was arrested at a New York City nightclub after she allegedly punched Tiffany Ava Mitchell, a psychic who she said was trying to read the actress' fortune. But Heller contends that Lohan "never made any physical contact" with Mitchell, and he believes the charges against the actress will be dropped.

"From my understanding, Lindsay was being approached by a fortune teller who sought to provide a reading to her and she politely said 'I don't want to participate' and declined," Heller told reporters. "You would think if [Mitchell] was a fortune teller, she would have been able to see this happening in advance. But obviously her skills weren't that honed.

"Lindsay Lohan did not commit any crime, she did not assault anyone, all she did is verbally request her privacy," Heller added.

Even if these charges are dropped, however, Lohan still faces several misdemeanors after she allegedly lied to California police about a car crash last June. As a result of that incident, her probation stemming from 2011 jewelry theft charges was revoked, and she now faces up to eight months in prison.

Lohan is next due in court Jan. 15 for a probation violation hearing.
