Gabriel Aubry, the father of Halle Berry's 4-year-old daughter, Nahla, successfully obtained a restraining order against her fiancé Olivier Martinez after claiming Martinez threatened to kill him during their Thanksgiving scuffle, TMZ reports.
According to Aubry's declaration, obtained by the website, Martinez first made aggressive remarks the day before Thanksgiving at Nahla's school play. Martinez whispered to Aubry in French, "I wish I could beat the [heck] out of you right now. You're lucky we're in a school right now. We're going to take Nahla right now, and you're not going to follow us."

On Thanksgiving morning, Martinez came out to meet Aubry and Nahla, instead of the nanny. Martinez told Aubry they needed to talk and as Aubry was getting in his car, Martinez knocked Aubry to the ground and slammed Aubry's head onto the concrete driveway.
During their fight, Martinez allegedly said that Aubry was going to move to Paris like them or he was going to kill Aubry. (Berry's request to move Nahla to Paris so she could live there with Martinez was denied by a judge, who said it would be harmful for Nahla to be that far from her father).
Aubry then claims Martinez said he called the cops and told Aubry, "you're going to tell them that you're the one who attacked me, or I'm going to kill you."

Authorities tell TMZ that Aubry did not mention these threats when he spoke to police immediately following the altercation.
An emergency protective order was already issued that requires Aubry to stay 100 yards away from Berry, Martinez, and Nahla.
