California law: Kris Humphries is "presumed father" of Kim Kardashian's baby

Earlier this week, Kim Kardashian announced that she's pregnant with boyfriend Kanye West's baby -- but there's one problem. Under California law, Kardashian's ex Kris Humphries is the "presumed father" of the baby since the two are still legally married, TMZ reports.

Legally, that means that Humphries could lay claim to the baby, and Kardashian would have to present "clear and convincing" evidence, such as a DNA test, that West is the biological father, according to TMZ.

It's doubtful whether Humphries would even want anything to do with the baby, as he is seeking to have his 72-day marriage to Kardashian annulled rather than agree to a divorce. The couple will likely still be legally married by the time Kardashian, who is reportedly 12 weeks along, gives birth. A hearing is scheduled for Feb. 15 to set a trial date.
